District Appeal Committee Dismisses Appeal Brought by Residents Opposing a Tama 38 Project

Persons residing in the vicinity of KKL Street in Givatayim filed an appeal against the Local Planning and Building Committee’s decision to approve the demolition of an existing building on the street and replace it with a new seven story apartment block. The District Appeal Committee dismissed the appeal, which related to the method of computing the building rights in respect of the parcel of land, holding that in order to compute the area of a typical floor of the building the total building rights capable of construction on the plot according to the applicable plans should, in the instant case, be divided into three stories and not as pleaded by the appellant’s, by the number of floors permitted according to the plans governing the site, plus the two floors that the Local Committee was empowered to authorise – five stories in the instant case.
