The court ordered the defendant to pay agreed liquidated damages of NIS 1 million for the breach of an undertaking to purchase real estate. The defendant had undertaken in a memorandum of understanding to purchase certain real estate but shortly after making the MoU he sought to withdraw the undertaking, claiming that he had been deceived by the vendors with regard to the planning position.
